SEUR Internacional general Conditions
1. Documents necessary for sending samples: To send samples to countries outside of the European Union, it is necessary to include a Proforma Invoice, in both Spanish and English. Samples being sent to countries outside of the EU may be subject to customs duty, which will be at the expense of the addressee.
2. Fuel Surcharge: international services are subject to a supplementary charge for fuel, the index of which is published and updated monthly at http://www.seurinternacional.com
3. VAT: Shipments to locations within the European Union will be increased by the relevant VAT.
4. Dangerous material: In accordance with international law, and regardless of what each country establishes specifically, any merchandise that is designated as “hazardous” will not be accepted, including therein: fuels, acids, radioactive substances, explosives, arms, etc. There are limitations regarding the shipment of liquids by air (courier), depending upon the destination, nature and amount of the shipment; therefore, the details regarding such shipments should be checked with our Customer Service Department. In other services, liquids may be shipped, provided that the relevant packaging is suitable for the type of transport (wine rack). Transporting gases (whether they are in a liquid state or not) is forbidden, except in those cases where the presentation and packaging is determined to be for personal use (such as aerosols, shaving foam, hairsprays, etc.)
5. Prohibitions: SEUR Internacional will not admit the following articles for shipment: jewellery, gems and other precious materials, money, foreign currency, bank notes, shares, payment instruments (unsigned credit cards, cheques, telephone cards, bills of exchange, bearer cheques, etc.) or any other documents used for payment, living or deceased animals, arms, drugs, medicines, works of art, merchandise that requires temperature control, any publications or audiovisual material forbidden under law, plants, dangerous materials, leather garments, the presentations for contests or tenders, alcoholic beverages or any type of merchandise that is forbidden by the customs Authorities within the territory. For any lawsuit that may arise between the parties, it is agreed that the Spanish courts will be the sole competent authority in this regard, for commercial lawsuits, regardless of what the place of origin and destination may be for the shipments.
6. Packaging: the customer is exclusively responsible for the relevant packaging. In the event that SEUR Internacional considers the packaging indicated by the agency to be insufficient, the shipment may be rejected. Packaging will always be the exclusive responsibility of the customer. Under no circumstances will the acceptance of a shipment by SEUR Internacional imply that it assumes any responsibility in relation to the suitability of the relevant packaging and it may reject a shipment whose packaging is clearly insufficient or unsuitable. For the shipment of bottled merchandise, we offer the use of our “wine racks”, which are especially designed to protect this type of shipments.
7. Delays that are not attributable to the Agency: The sender will be liable for any transported merchandise that is not delivered due to absence or rejection on the part of the addressee, or because the delivery information was deficient, or because certain amounts arising from the shipment were not paid (freight, insurance, taxes, expenses….) The sender will be obliged to assume, at his/her expense, all the costs of said circumstance, including therein and as the case may be, the costs of returning the shipment to its place of origin and subsequent deliveries thereof, including the deflection of the relevant insurance.
8. Insurance for the declared value: The sender, declaring the real value of the merchandise, may request that the contracting agency take out supplementary insurance with the insurance company that the agency deems suitable to cover any damages that said merchandise may suffer, up to the declared value thereof. The price for this insurance will be 1.25% of the declared value (the minimum amount being € 6.01). If said insurance is not subscribed, the maximum contractual liability indicated for the different services will be applicable. The foregoing is aside from the documents that are necessary to transport the merchandise, wherein reference is made to its value or its contents, which documents will be considered as extra-contractual declarations, for the purposes of management vis-à-vis third parties (except for “Cargo Plus Service”).
Conditions for SEUR Courier Service
1. Documents: Photographs, pamphlets, magazines, CD’s, etc. are not considered to be documents.
2. Transit Time: The days calculated for transit (in working days) are guidelines and they correspond to documents dispatched to the operative capitals of said countries; always from cities in Spain with which SEUR has daily international connections and with the carriage paid at the place of origin (please consult our Commercial Department in this regard).
3. Weights and measurements: In accordance with international law, no package sent by courier service can surpass 31.5 kilos. The following dimensions are established in this regard:
     a. Maximum length for the package’s longest measurement = 175 cm.
     b. Total length must be less than or equal to 300 cm., based on the following method of calculation:
         Total Length = Length (in cm.) + Width (in cm. x 2) + Height (in cm. x 2)
     c. Minimum dimensions = an envelope measuring 22.9 cm. x 16.2 cm.
     d. The ratio of weight/volume is calculated in accordance with the IATA rules and based on 1m3 = 167 kilos, or

4. Export: All dispatches for countries outside the EU that weigh more than 15 kilos, or which have a value in excess of € 150, are subject to customs clearance, amounting to €15.03, and an increase of 24 hours in the relevant transit time.
5. Maximum liability: The maximum liability for the transport company (for any damages, losses or breakdowns that the merchandise may suffer, except for delays) will be:
     a. Documents - a maximum of € 300.51 per dispatch
     b. Samples – a maximum of € 1,202.02 per dispatch
     c. In those cases where fulfilling the guarantee established under sections a and b is not applicable, the maximum liability that is established under the international laws for air navigation at any given time will be applied.
6. Claim period: In accordance with that established under Article 124 of the Air Navigation Act, lawsuits to claim compensation for any damages or losses prescribe after six months, as from the date said damages or losses occurred.
Any claims arising from breakdowns or delays must be formalised in writing and sent to the carrier from which the contracted service was requested, within a period of ten days after the delivery or, if such delivery was not made, after the date it should have been made. Said period is not extendable and any breach thereof shall impede the relevant actions from being taken.
7. Safety rules for air transport:
The customer must ensure and substantiate, upon filling out the relevant dispatch note or when the goods are turned over, that the shipment in question does not contain any forbidden items, according to the national and international laws governing air transport safety. Likewise, the customer is obliged to provide a complete description of what the shipment contains, in the dispatch note. The customer’s liability is not waived by providing such information. The customer is hereby informed that his/her shipments may be submitted to safety checks, which could include the use of x-ray equipment, and that the shipment may also be inspected and opened. The customer certifies that the shipment has been prepared in safe facilities, by trustworthy employees and that it has been protected from any type of illegal interference while it was being prepared, stored and transported, prior to its being accepted for transport.
8. Cash on Delivery (C.O.D.): This service is not available.
Conditions for SEUR Classic Intercontinental Service
1. Conditions for delivery: The shipments will be carried out in the following manner: “DDU” (Delivered Duty Unpaid; free home delivery excluding the customs formalities and duties for import).
2. Weights and measurements:
     a. Maximum number of packages per shipment: 3
     b. Maximum weight per package: 31.5 kilos
     c. Maximum length per Packaged: 175 cm.
     d. Basic calculation of maximum volume:
         Length (in cm.) + Width (in cm. x 2) + Height (in cm. x 2), the result of which must be less than or equal to 300 cm.
     e. The ratio of weight/volume is calculated in accordance with the IATA rules and based on 1m3 = 167 kilos, or

3. Customs formalities: The customs formalities for export are included in the fees. Customs clearance, taxes and duties at destination are not included.
4. Special supplements: There will be a supplementary charge in the case of changes in the address or for the third time the delivery is attempted.
5. Transit Time: The transit times quoted for Classic Intercontinental Service are merely indicative from Madrid to the domicile at the final destination, except in the following cases, in which the door-to-door service is only to the relevant capital: Algeria, Nicaragua, Palestine, Russia and Tunisia. In the case of shipments consisting not only of documents, delays may arise due to customs formalities, both at the place of origin as well as at that of the destination.
6. Maximum liability: SEUR’s liability is limited to 17 SDR (Special Drawing Rights), which is equivalent to approximately USD 25.50/€ 20 per kilo of gross weight.
7. Claim period: In accordance with that established under Article 124 of the Air Navigation Act, lawsuits to claim compensation for any damages or losses prescribe after six months, as from the date said damages or losses occurred. Any claims arising from breakdowns or delays must be formalised in writing and sent to the carrier from which the contracted service was requested, within a period of ten days after the delivery or, if such delivery was not made, after the date it should have been made. Conditions for SEUR Classic Service by Road
1. Delivery conditions: All shipments will be made to the addressee’s domicile free of charge. For addressees that are not part of the EU, there are two possible types of shipment:
     a. DDU (Delivered Duty Unpaid; free home delivery excluding the customs formalities and duties for import)
     b. DDP* (Delivered Duty Paid; free home delivery including, including the customs formalities and duties for import)
        (*) Only applicable to destinations in Norway and Switzerland.
2. Weights and measurements:
     a. Maximum weight per package: 31.5 kilos (and each package will be considered one shipment)
     b. Maximum length per Package: 175 cm.
     c. Basic calculation of maximum volume:
         Length (in cm.) + Width (in cm. x 2) + Height (in cm. x 2), the result of which must be less than or equal to 300 cm.
3. Customs Formalities:
     a. Export: The customs formalities for export are included in the fees.
     In the case of DDP shipments, the amount for customs formalities at the destination are the following:
         i. Switzerland: € 16 plus the relevant taxes.
         ii. Norway: € 18 plus the relevant taxes.
     Shipments with a unit value that is greater than or equal to € 1,000 must be accompanied by an original commercial invoice or value declaration in English, wherein the following information is stated:
    1. The merchandise’s country of origin
    2. The HS code (customs classification) for each of the products that comprise the shipment.
    3. Product units, unit values and overall value.
4. Special supplements: for the islands of Corsica, Sardinia, Sicilia and Man, a supplement of € 15 will be added to the fee.
5. Transit Time: The periods indicated do not include weekends or holidays in any of the countries through which the shipment is transported. Transit times are mere guidelines, when not an Express Service, and they refer to shipments made from Spain.
6. Maximum liability: The maximum liability is € 520 per package / shipment, which is included in the price.
7. Claim period: In accordance with that established under Article 30 of the C.M.R., within seven days after receiving the merchandise, claims may be made against the Transportation Agent for damages or breakdowns, unless said damage was evident at the time the merchandise was received, in which case the claim will only be accepted when the shipment was received. Once said periods have elapsed, no claim regarding the condition in which the transported goods were delivered may be brought against the Agency. Once the indicated claim periods have elapsed, any lawsuits arising from the transport contract will prescribe after a year.
8. Cash on Delivery (C.O.D.): This service is not available.
Conditions for SEUR Netexpress Service
1. Transit time: The periods indicated do not include weekends or holidays in any of the countries through which the shipment is transported. The transit times that have been established refer to shipments made from Spain. Transit times are not guaranteed for shipments made to fairs, private addresses, C.O.D. shipments or those made to consignees who receive merchandise within restricted hours.
2. Delivery conditions: All shipments will be made to the addressee’s domicile free of charge.
     For destinations that are outside the EU, there are two types of shipment:
     c. DDU (Delivered Duty Unpaid; free home delivery, excluding the customs formalities and duties for import)
     d. DDP* (Delivered Duty Paid; free home delivery, including the customs formalities and duties for import)
         (*) Only applicable to destinations in Norway and Switzerland.
3. Weights and measurements:
     a. Maximum weight allowed per package is 1,000 kilos
     b. Maximum measurements allowed per package: 3 m. x 1.2 m. x 1.7 m. (height)
     c. Ratio of weight / volume is calculated and based on 1m3 = 167 kilos, or

4. Special services: Those services related to International pick up or delivery, for shipments that surpass the weights and measurements established, or which require that they be done at a specific time or within a specific period or by assistant staff, will be subject to a supplement over the fee price.
5. Customs Formalities:
     a. Export: € 20 for customs clearance at the place of origin and 50€ for clearing customs at the place of destination.
     b. Import: € 35 at the place of origin and the official duty at the destination.
6. Special Supplements:
     a. Isle of Corsica: Supplement equal to 25% of the price for France.
     b. Isle of Sardinia, Sicilia: Supplement equal to 25% of the price for Italy.
     c. Channel Islands and the Isle of Man: Supplement equal to 25% of the price for the United Kingdom.
7. Cash on Delivery Service (C.O.D.): The Netexpress C.O.D. Service consists of delivering the merchandise to the addressee, in exchange for a cheque issued by the latter for the amount requested by the sender, who acknowledges and accepts said form of payment. Only cheques drawn from nominative bank accounts by the addressee to the sender shall be accepted as payment. The Transport Agency is not responsible for the actual collection of the cheques that are turned over by the consignee. The C.O.D. amount that is ordered by the sender must be established in the currency of the country of destination. Shipments with special delivery conditions shall have a supplement equal to 5% of the C.O.D. amount, with a minimum of € 30.05 and a maximum of € 90.15, for administrative fees.
8. Maximum liability: The liability of the transportation company for damages, losses or breakdowns suffered by the merchandise is limited to a maximum amount of € 10/kilo, according to that established under the C.M.R. Convention, Protocol 5/7/78 (8.33 Units of Account / DEG. per kilo).
9. Claim periods: In accordance with that established under Article 30 of the C.M.R., within seven days after receiving the merchandise, claims may be made against the Transportation Agent for damages or breakdowns, unless said damage was evident at the time the merchandise was received, in which case the claim will only be accepted at the time of receipt. Once said periods have elapsed, no claim against the Agency will be accepted, regarding the condition in which the transported goods were delivered. Once the indicated claim periods have elapsed, any lawsuits arising from the transport contract will prescribe after a year.
Conditions for SEUR Cargo Plus Service
1. Transit Time: It is variable, depending upon the country of destination and space available on the airlines. Under normal conditions, the transit times are estimated to be those indicated in the chart. Customs delays at destination are not included in the days calculated for transit.
2. Ration weight/volume: Depending upon the country of destination, limitations may exist for the weight and dimensions of each package. Please consult with the Commercial Department in this regard. The ration of weight/volume is calculated on the basis of 1m3 = 167 kilos, or

4. Packaging: The sender is obliged to turn over the merchandise duly packaged and labelled, and properly protected in accordance with the relevant contents. In general, wood packaging (pallets, boxes, frames, etc.) are subject to plant health controls at the customs office of the relevant country of destination. As a general rule, it is required that wood be fumigated and that such measure be evidence by means of the relevant Certificate issued to such end by the authorised company or official agency. When the merchandise must be stored in pallets or included in rigid packaging, it will be required that plastic or metal elements be used, or wood (with a certificate of fumigation).
5. Maximum liability: Maximum coverage of $ 20/kilo of gross weight, according to that established under the Warsaw Convention.
6. Insurance of Declared Value: The sender, declaring the real value of the merchandise, may request that the insurance cover any damages that said merchandise may suffer, up to the declared value thereof. The premium for this insurance will be 3% of the declared value (minimum amount of premium 95%).
7. Claim period: In accordance with that established under Article 124 of the Air Navigation Act, lawsuits to claim compensation for any damages or losses prescribe after six months, as from the date said damages or losses occurred.
