SEUR Internacional: General conditions
1.Documents needed for a samples shipment (to private consignee not belonging to the U.E.):
To send samples (to private consignees not belonging to the U.E.), it is mandatory to enclose a Proforma invoice in both languages spanish and english.
The samples addressed to the private consignees who don't belong to the U.E. can be subject to pay customs clearance, which normally has to be assumed by the consignee. If the sender wants to assume that cost, must comunicate it to the Customer Services Department to process that order in those cases in which can be done.
2. VAT:
The shipments which have their final destination whithin the U.E., will be charge with the VAT extra cost.
3. Dangerous goods:
According with the International laws and apart from the ones that each country stablishes specificaly, will be not accepted those goods designated as "Dangerous goods" such as: fuels, acids, radiactive materials, explosives, weapons, etc. The shipment of fluids (liquids) is restricted to an amount not higher than 1 Kg. (To be consulted, depending on each particular case). Gas (weather if it is liquid or not) are forbiden to transport, unless in those cases in which depending on their presentation and packing can be considered for a personal use (aerosols, shaving foams, perfumes in spray, etc).
4. Prohibitions:
Seur Internacional will no accept as a shipment: cash, bearer checks, credit cards without being signed, jewels, ingots and similars,antiques,stamps, precious metals, orders of payment,plants, drugs, works of art, precious stones,travel cheques,animals,perisable products or materials, fuels or dangerous materials (unless for the service of the Custom Clearance service,providing that mandatory requirements are carried out in each case),goods and objects of which transport will be forbiden for any legal resolution or the other nature, enacted by a Relevant Authority from any of the countries from the origin, destination or transit of the shipment.
For any dispute which could come after between the parties, it is agreeded the only competence of the Court of Madrid whtich deals with commercial disputes, wherever is the origin or destination of the shipments.
5. Packaging:
Packing is exclusively under the resposability of the customer.If Seur International considers that packaging is unsufficent,could reject the shipment.
Bottles:
If you would like to send glass bottles, we can provide you our exclusive packaging "Wine-Rack", specially designed to protect these kind of goods.
6. Custom Clearance:
Samples addressed to particular consignees, who do not belong to the U.E., can be subject to pay customs clearance,which normally has to be assumed by the consignee. If the sender wants to assume that cost,must comunitate it to the Customer Services Department to process that order in those cases in which can be done.
7. Delays not chargeable to the Agency:
The non delivery of the transported goods due to both absence or refusal by the consignee,deficiency on the consignee contact details or default of payment of the amounts as consequence of the transport (transport, insurances, taxes, expences...), will be under the responsability of the sender, who will have to assume all the expences of that incidence including, the expences of the deposit, price and rest of goods transport expences derivated of the return of the goods to the origin or subsequent deliveries and the corresponding insurance expence.
8. Delivery Guarranty:
In case of a breach in the times of delivery defined on the contract and depending on the service that has been purchased, the Carrier will refund, as a compensation for the inconveniences, the amount corresponding to the transport service.
It will not be considered a breach of the times of delivery that one due to the absence of the consignee, change of address, consignee or unknown address,default of payment, Close for vacations, deliveries out of deadline on the second attempt of delivery, reasons beyond a reasonable control, any fortuitous causes or any other not allocable to the Carrier.
Ground transportation Terms and Conditions (NetExpress)
These Terms and Conditions are additional to the
Seur International General Terms and Conditions.
1. Goods restrictions:
Next goods can not be transported using the Netexpress Service:
Noble materials, precious stones, jewlery objects, sumptuous furs,cash money,coins or stocks, antiques,objects or works of art within a collection, with historial value rico and catalogued or non catalogued but with a value equal or superior at 961,62€ per piece. Weapons, ammunitions,plants,animals, fourniture, perishable articles or materials that might get damaged by the effect of temperature, goods with unsufficient packaging according to the characteristics of the content y dangerous goods subject to Dangerous Goods Regulations by Law and of which transport is subject to special requeriments.
2. Liability Limits:
The Liabilty of the Carrier, regarding the damages, losts and breakdowns that the goods might suffer,except for delay on the delivery, of which case will apply the Point number 8 of Seur International General Terms and Conditions,being limited as maximum the amount fo 10€ per kilogram according to the CMR Agreement, Protocl 5/7/78 (8.33 Account units/DEG per Kg).
3. Declared Value Insurance:
The Customer can ask to the Agency a new insurance policy with the Insurance Company that the Customer designates as the choosen one, which includes an additional insurance that covers, with a Real Value Declaration, the damages that the goods might suffer until their declared value. The price of that new Insurance policy will be the 1,25% of the declared value(with a minimum amount of 6,01 euro). In that case wil not apply the clause detailed in the previous paragraph. If this addional insurance policy will not be contracted, it will be applied in any case, the Contractual Liability Limits described on paragraph 2. The previous clause will not be affected by the neccesary presentation of documents in which, in order to fullfil the transit of goods, will show their value or content, which will be considered as an extracontractual declaration, and as a formality procedure in the presence of third parties.
4. Packaging:
The sender is obliged to give the goods duly packaged and labelled, being the goods properly protected according to the characteristics of the content. If the Customer wants to send glass bottles, we can get at his/her disposal our exclusive "Winerack" Package for this purpose, which has been specially designed to protect this kind of shipments.
5. Delivery Terms and Conditions:
The expeditions will be made under the following serán efectuadas bajo las siguientes modality:
FD
: Free domicile.
FDU
: Free domicile not cleared (*).
FDC
: Free domicile cleared (*).
(*) To be applied on expeditions with origing or final destination on Non European Countries.
6. Weights and measures:
Maximum weight authorized per piece is 1.000 kg.
Maximum measures authorized per piece: 3m. X 1,2m. X 1,7m. (altura)
7. Customs Clearance Formalities:
Exports:
18,03 € in origin y 48,08 € in final destination.
Imports:
30,05 € in origin y Official fares in final destination.
8. Relation Weight/Volume:
The relation Weight/Volume is calcuted on the basis 1 cubic meter=
167 Kg

9. Special subcharges:
Corsica Island: 25% subcharge on Tariff Zone 1.
Sardinia,Sicily, Channel and Man Islands: 25% subcharge on Tariff Zone 2.
10. Cash on Delivery Service (C.O.D.):
The Netexpress C.O.D. service consists on the delivery the goods to the consignee by giving a cheque for the amount of the money indicated by the sender, who agrees and acept this way of payment. As a way of payment of the issued amount, it will be only accepted order chequess issued by the consignee and addressed to the sender. The Agency will not take any responsability about the end of the cheque given by the consignee. The amount of money requested on the cash on delivery order must be requested on the final destination country currency. Expeditions with delivery condicionated by cash on delivery payment have a subcharge of 5% of the cash on delivery amount, plus 30,05 € and 90,15 €, as a management subcharge.
11. Transit times:
Transit times do not included weekends, any bank holidays of the countries where the goods pass through.
Times of transit drawn up are referred to the expeditions sended from Spain. Transit times will not be guarranted when the shipments are addressed to Fairs, private addresses, cash on delivery shipments or consignees whom their goods reception is subject to schedule restrictions.
12. Minimal billable amount:
It will be applied only in expeditions with a weight superior to 100 Kg., when the result of multiply the number of kilos times the applicable tariff, is lower than the minimal billable amount. P.G.: 117 Kg. to France x 1,34 € = 166,78 € Applicable tariff 175,39 €
13. Claiming terms:
According to the Article 30 within C.M.R., within the next 7 days to the reception of the goods, claim against the agency for damagesor breakdown will be able to be done, unless the damages were obvious on the moment of the reception of the goods, in which case a claim would be accepted in the same moment when of the reception. After the detailed terms, any claim against any agency about the state of the goods will not be admited. After the Claiming terms mentioned previously, actions derived from the transport contract will prescribe in one year.
Air transport Terms and Conditions(Courier)
These Terms and Conditions are additional to the
Seur International General Terms and Conditions.
1. Documents:
They are not considered as documents: photolithographs, photographs, magazines or diskettes.
2. Guarranty coverage:
The shipment sent by courier includes a coverage against lost, steal or damages until 300,51 € for documents and until 1.202,02 € for samples.
3. Transit times:
Days of transit (working days) are just an orientation and apply to the documents sending to the operative capitals of the mentioned countries.That will apply always from the spanish cities with the daily junction of Seur International. (Please ask to our Commercial department).
4. Weights and measures:
According to the International law, each piece sent by courier service can not exceed of 30 Kg. neither on weight nor dimmensions of 1,30 m x 0,5 m. The relation weight/volumen is calculated acording the IATA rules as follows: 1 cube meter=
166,6 kg.

5. Exports:
If you need carry out commercial exports using our courier service, you can carry it out with a subcharge of 15,03 €. The transit time in this case, will be increased in 24 hours.
6. Liability limits:
The maximum responsability of the Carrier regarding damages, losts or breakdowns of the goods, except for the delay on the delivery will be of:
Documents 300,51 € maximum per expedition.
Samples 1.202,02 € maximum per expedition.
In those cases which, for any circumstance, can not be applied the stablished coverage of guarranty detailed on the paraghaphs A and B, it will be applicable the liability limits stablished in each moment by the International Law of Air Navigation.

8. Claiming terms:
According to the Article 124 of the Air Navigation Law about Air Navigation, the procedure to demand the payment of the compensation for damages, losts and delays will prescribe on the next 6 months after the date when the facts occured.
claims for breakdown or delay must be formalized on written in presence of the carrier which is obliged within the next 10 days from the delivery date or the estimated delivery date. The ausence of this previous claim will hinder the exercise of the applicable actions.
Multimail Terms and Conditions
These Terms and Conditions are additional to the
Seur International General Terms and Conditions.
Shipments with final destination within the European Union will be increased with the applicable VAT.
The Multimail service of Seur International includes picking up the goods, air transport to main european distribution centres and the subsequent postage as first class mail until its final destination.
This service is just valid for the shipments named as "non básic documents"( forms, catalogs;logos y panflets) with a minimun of 100 units per shipment.
